RE: The tariff classification of an electric motor assembly from multiple countries

Dear Mr. Valdez:

In your letter dated June 23, 2016 you requested a tariff classification ruling.

The item under consideration is an electric motor assembly which is used in electronic power steering applications. The motor assembly is described as a 12V DC motor having an integrated electric control unit. The control unit consists of two printed circuit board assemblies, electrical connectors, and a cover/base that is directly mounted to the motor. On the exterior of the motor assembly are multi-pin electrical connectors that connect to onboard vehicle systems. You state that the motor has an output of 1 horsepower, which is equivalent to 746 Watts.

The applicable subheading for the electric motor assembly will be 8501.31.6000, HTSUS, which provides for "Electric motors…: Other DC motors;…: Of an output not exceeding 750 W: Other. The general duty rate will be 2.4%.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at https://hts.usitc.gov/current.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Karl Moosbrugger at [email protected].
